Knife Rights Statement on Franklin Regional High School Attack

April 9, 2014: Knife Rights, representing law-abiding knife owners, is shocked and saddened by the news of the appalling and senseless attack at Franklin Regional High School in Pennsylvania.

Out of respect for the victims and their families and due to the lack of a full set of facts on this attack at this time, we will have no further comment until more facts on the attack are available.

 
Tennessee Switchblade Ban Repeal Bill Signed by Governor Haslam

Tennessee Governor Bill Haslam has signed SB1771, Knife Rights' bill repealing the state's antiquated ban on switchblade (automatic) knives and possession of knives over four inches in length "with intent to go armed," a vague law subject to abusive interpretation. As of July 1, 2014, there are no longer any per se illegal knives in Tennessee.

Last year Knife Rights passed Knife Law Preemption in Tennessee ensuring that no local jurisdiction can have regulations more restrictive than state law. This means that existing restrictions that banned automatic knives or limited blade length in some cities are now rendered null and void and they cannot pass any new laws banning certain knives.

WARNING: This new law does not go into effect until July 1, 2014. Violations of existing law banning switchblades (automatic) knives and carry of knives over four inches in length "with intent to go armed" can still be prosecuted until that date.

Kansas Legislature Passes Knife Law Preemption Fix - CALL or EMAIL Governor Brownback NOW!

April 5, 2014: In the waning hours of its 2014 legislative session the Kansas House passed HB 2578 by a vote of 102-19. It passed in the state Senate yesterday by a 37-2 vote. HB2578 includes Knife Rights' fix to address the Attorney General's adverse, and questionable, opinion that the preemption language in Knife Rights' Comprehensive Knife Reform bill passed last year did not repeal existing laws more restrictive than state law. HB2578 now moves to the Governor for his consideration.

Ivory Ban Update - Coalition Letter Sent to FWS and Congress

April 4, 2014: A coalition letter opposing the Ivory Ban was sent today to U.S. Fish and Wildlife Service Director Daniel Ashe from 31 organizations representing a wide variety of impacted communities opposed to the ivory ban. As one of the founders of the coalition, Knife Rights was honored to be joined on the letter by the Custom Knife Collectors Association, the National Knife Collectors Association, the Professional Knifemakers Association and The Knifemakers' Guild, as well as the industry's American Knife & Tool Institute. The purpose of this letter was to put the Administration, the Fish and Wildlife Service and the House Appropriations Committee, as well as Members of Congress, on notice that this ivory ban will adversely affect a large number of Americans.

Please contact your Representative and Senators and let them know you oppose the Administration's new total ban on commercial sale and trade of pre-ban ivory that unfairly impacts millions of law-abiding Americans and which they have not shown will have any effect on poaching or the trade in illegal ivory.

The next step in our coalition strategy is for each of the impacted communities to present FWS with their own letter, which can be more specific in the nature of the adverse impact to that community. Oklahoma Knife Law Preemption Bill Passes House - Now on to Senate - CALL/WRITE Today!

Feb. 27, 2014: By an overwhelming 88-3 vote, the Oklahoma House has passed HB3367, Knife Rights' Knife Law Preemption bill. Sponsored by state Representative John Echols, HB3367 very simply adds "knives" to the state's existing Firearms Preemption Law. The bill now moves to the Senate.

Knife Rights' Knife Owners' Protection Act Introduced in U.S. Senate!

Jan. 18, 2014: Senators Mike Enzi (R-WY) and Mike Lee (R-UT) have introduced a complimentary Senate version of Knife Rights' Knife Owners' Protection Act, S.1955 (KOPA), This follows the introduction of Knife Rights' KOPA bill in the House last November. The Senate bill is based on the House bill as conceived and developed by Knife Rights, although it is formatted according to Senate rules. Knife Rights worked diligently with the Senate sponsors to ensure the Senate bill was fully aligned with the original House KOPA bill.

Knife Rights To Appeal Outrageous Ruling in NYC Case

Dec 23, 2013: Knife Rights has a filed a Notice of Appeal in its federal civil rights lawsuit against New York City, following a judge's refusal to allow supposed "defects" in the case documents to be corrected. The judge previously used those "defects" to try to throw out the case.

U.S. District Judge Katherine B. Forrest previously held that the plaintiffs don't have standing to sue, because the complaint didn't identify specific knives that would be illegal under New York City's misinterpretation of state law. Ironically, the whole point of the case is that it's nearly impossible to figure out what is legal or illegal under New York City's haphazard and inconsistent approach - even the DA has admitted that different specimens of the exact same make and model knife could be simultaneously found to be both legal and illegal!

Knives and the Second Amendment Published

Knives and the Second AmendmentThe first detailed scholarly analysis of knives and the Second Amendment has been published in the University of Michigan Journal of Law Reform (vol. 47, pages 167-215). Authored by noted Second Amendment scholars Dave Kopel, Clayton Cramer and Joe Olson, the paper makes the case for knives as "arms" protected by the Second Amendment, supporting one of Knife Rights' foundational tenets.

Knife Rights applauds these scholars for this long-overdue effort. This is a great start on the sort of scholarly work that needs to be done to assist in potential legal cases down the road. The arguments made and supported in this article will also support our legislative efforts to roll back knife bans and oppose proposed new restrictions on knives.

Knife Rights' Knife Owners' Protection Act Introduced in Congress

Nov. 14, 2013: Knife Rights' Knife Owners' Protection Act, H.R.3478 (KOPA), has been introduced in the U.S. House of Representatives by sponsor Rep. Matt Salmon (R-AZ). Knife Rights Chairman Doug Ritter explained, "KOPA will protect law-abiding knife owners travelling throughout the U.S. from the vagaries of restrictive state and local laws. As long as possession of the particular knife is legal in the state where the journey starts and ends, and provided the knife is secured in accordance with KOPA, a knife owner would no longer be threatened with arrest simply for traveling from one place to another." KOPA is the first proactive pro-knife federal legislation introduced in the nation's history.

Alaska Gov. Parnell Signs Knife Rights Bill

June 21, 2013: After two years of effort, Alaska Governor Sean Parnell has signed HB33, Alaska's Knife Rights Act, which enacts sweeping reform of Alaska's knife laws. HB33 legalizes the possession, transfer and carrying of automatic knives (switchblades). It also enacts knife law preemption repealing all local knife laws as well as preventing new ones from being enacted. The effective date of HB33 is September 18, 2013.

At the invitation of Governor Parnell, Knife Rights Director of Legislative Affairs, Todd Rathner (far right in photos), attended the signing ceremony in Palmer, Alaska.

Knife Rights would like to thank Governor Parnell for recognizing and expanding the rights of everyday Alaskans as well as the millions who visit Alaska every year to hunt, fish and recreate. Tennessee Knife Law Preemption Signed into Law by Governor

May 17, 2013: Tennessee Governor Bill Haslam signed SB1015 today making Tennessee the Seventh state to enact Knife Rights most important legislative initiative, Knife Law Preemption.

SB1051, sponsored by Senator Mike Bell and with its companion bill, HB0581, sponsored by Representative Vance Dennis, repeals all existing local knife laws on the books in Tennessee and prevents cities and towns from enacting any new knife laws more restrictive than state law.

The original bills also addressed those state laws by including a repeal on the ban on switchblades, dirks, daggers, stilettos and knives over four inches in length, but because of petty political reasons that section was stripped from the bill. The preemption section that remained and has now been signed into law is arguably more important and a huge step in the right direction. However, Knife Rights is committed to passing commonsense repeal of the ban on these knives next year.

Knife Rights Federal Civil Rights Lawsuit Against New York City and NYC DA Cyrus Vance, Jr.

Knife Rights is the lead plaintiff in a Federal Civil Rights lawsuit originally filed in June,2011, against New York City and New York County District Attorney Cyrus Vance, Jr.over their wrongful harassment of knife owners, retailers and manufacturers.  As this lawsuit works its way forward, we will post newsworthy events and links to articles, motions and other relevant information here (Click on "Read More >>>>" below for links).

Lawsuit Summary: The lawsuit challenges New York City’s and District Attorney Vance’s attempt to criminalize as contraband the most widely-owned pocket knives in America -- one-hand opening and assisted opening folding knives -- under state laws prohibiting switchblades and gravity knives. The case seeks a judicial determination that the New York State laws regarding switchblades and gravity knives are unconstitutionally vague as applied by NYC and the DA to these common pocket knives (which are distinct from gravity knives and switchblades because of their bias towards closure). Knife Rights' lawsuit intends to stop New York City officials from abusing this vague state law to make bogus arrests of law-abiding citizens carrying common pocket knives, and from coercing knife retailers into making huge payments to avoid prosecution.(Click on "Read More >>>>" below for links to background articles)

Kansas Comprehensive Knife Rights Bill Signed by Governor!

April 16, 2013: After two years of hard work, Kansas Governor Sam Brownback has signed the Knife Rights comprehensive knife law reform act, HB2033 into law today.

HB2033 repeals all existing local knife laws in Kansas and enacts statewide preemption of any attempt to pass new local knife laws more restrictive than state law. HB2033 also repeals the ban on the possession of switchblades, dirks, daggers and stilettos. Be advised that the new law does not go into effect until July 1st.

We would also like to thank Patricia Stoneking, the President of the Kansas State Rifle Association, for her help and counsel throughout this long process!
